Forfeiture Law and The Proceeds of Crime

Forfeiture law has a long history and its more recent evolvement has been quite dynamic and will continue so. It has been described by the Chief Justice of the High Court of Australia as a global phenomenon. The introduction of forfeiture legislation has provided Governments, world wide, not only with an important tool to combat serious crime but also presents an important revenue raiser.

The information provided is aimed towards supplying a better general understanding of the following legislation:

• Proceeds of Crime Acts POCA (Cth) 2002;

• Criminal Assets Recovery Act CARA (NSW) 1990;

• Confiscation of Proceeds of Crime Act COPOC (NSW) 1989; and

• The various proceeds legislation that exists in each state.
