The Proceeds Practice

Recent developments in Proceeds of Crime law both at a domestic, national and international level has signified that a multi-disciplinary approach is often required. Such an approach is unusual in law but common in other professional endeavours. Some proceeds of crime matters require defined accounting skills and in this regard the skills required may be that of an investigative accountant or those of a Chartered Accountant/registered auditor.

 

Other matters may require, from a legal perspective the skills of an investigative solicitor whilst the skills of Counsel experienced in this area of law will compliment whatever work accountants and solicitors can contribute.

 

Having regard to the above, on a case-by-case basis a determination will be given as to whether a multi-disciplined approach is appropriate. In these circumstances, the following people may be recommended, having regard to their particular skills.

 

ACCOUNTING

 

Michael Mundt - Daley & Co; Chartered Accountant/Registered Auditor

  • Michael has appeared both in Australia and Internationally for defendants confronted by proceeds of crime proceedings. His particular skills in auditing are not only required, but necessary, in particular to form a financial platform and for a defendant to meet compliance with regulatory and statutory financial requirements.

  • Kate has recently has been called on to conduct proceeds of crime litigation across Australia and has demonstrated great skill in not only litigating matters, but also importantly, pursuing resolution.

 

Shane McAllister - Solicitor

  • Shane, as many would know, worked directly with me for in excess of 6 years developing, in particular, relationships with lawyers and accountants prosecuting proceeds of crime matters, his skill, judgment and expertise become important tools when conducting proceeds of crime litigation.

 

Tim O’Connor - Solicitor

  • Tim was for 25 years an Executive Director of Investigations at the NSW Crime Commission. He brings to the multi-disciplinary team, in-excess of 40 years of criminal investigative experience which he has now converted to the benefit of defendants in proceeds of crime proceedings. More recently he has focused upon proceeds of crime proceedings commenced by the Australia Federal Police under POCA and has the peculiar advantage of prosecuting and defending proceeds of crime litigation.
